Summary
Heard 14 October 2008, promulgated 31 October 2008 (Senior Immigration Judge Warr, on reconsideration). The appellant, a documented Bedoon who left Kuwait on a valid Article 17 passport, personally destroyed that passport after departure and claimed asylum as an undocumented Bedoon. The original Immigration Judge allowed the appeal, reasoning that the destruction itself created a real risk the Kuwaiti authorities would refuse to issue a replacement.

ON RECONSIDERATION, THE TRIBUNAL SUBSTITUTED A FRESH DECISION DISMISSING THE APPEAL ON ALL GROUNDS: the original judge had erred in law by treating the mere fact of destruction as sufficient, without properly assessing — on the evidence actually before him, including passages in BA and Others [2004] UKIAT 00256 recording that the Kuwaiti authorities do issue emergency/replacement documents in some circumstances — whether a replacement would genuinely be refused. On these particular facts (no prior persecution, a passport still within its validity period, and a history of employment and medical treatment in Kuwait), the appellant had not discharged the burden of showing a real risk of refusal.

USE IN A REPORT: cite for the precise, narrow principle that document destruction is not itself determinative — it shifts the evidential question to whether a replacement would actually be refused, which must be assessed on the individual facts (validity period, prior treatment by the authorities, any history of adverse interest) rather than assumed. Distinguish carefully from a genuinely undocumented Bedoon (BA, HE, NM) or one whose Article 17 document had already expired before departure (the second appellant in BA) — this case turns specifically on a still-valid document destroyed after the fact.
Kuwait Mirror Comment
A narrow but practically important qualification on the documented/undocumented distinction — relevant wherever a client's own prior documents (not their absence) are the contested issue, and a caution against assuming destruction alone converts a documented Bedoon into an undocumented one.
